TERMS & CONDITIONS

YOUR CONTRACT

This document forms a legal contract between the traveler and CapturEDU. By securing a trip with CapturEDU, you consent to be legally bound by these Booking Conditions. CapturEDU offers the services mentioned in your booking confirmation invoice, which is an integral part of this agreement.

During your booking process, you confirmed that you have read and understood these Booking Conditions, so that you can establish a binding contract between you and CapturEDU. We are dedicated to providing the specified services under this agreement, subject to the terms and conditions outlined herein.

BOOKING REQUIREMENT

To confirm your reservation with CapturEDU, you must complete the booking form on our website. You agree to pay a non-refundable deposit or the total amount due, as stated in your booking confirmation invoice. This payment, which is required at the time of booking, will be interpreted as acceptance of the terms and conditions outlined in this agreement.

We reserve the right to cancel your reservation if we do not receive the necessary payment. Furthermore, we reserve the right to modify the deposit amount or payment terms as needed for particular tours or workshops based on the trip's nature at CapturEDU's discretion. We will notify you of any changes to the booking requirements, and your reservation will be subject to the updated terms and conditions as communicated.

ACCEPTANCE OF BOOKING

Upon receiving your payment and accepting your reservation, CapturEDU will send you a booking confirmation invoice, which validates the services to be provided. This document establishes a legally binding contract between you, the traveller, and CapturEDU, which becomes effective on the date of the booking confirmation invoice.

CapturEDU reserves the right to decline any reservation application at its sole discretion, in which case any payment made will be fully refunded. The contract may also be terminated if you fail to adhere to the terms and conditions outlined in this agreement or if your conduct infringes upon local laws or norms. In the event of such termination, refunds may be issued at CapturEDU's discretion after covering any costs incurred.

REFUND POLICY

Please be aware that any payments made when booking with CapturEDU are non-refundable. However, you have the right to transfer this payment to a different workshop scheduled within 12 months of the original workshop date.

If you give any notice of cancellation within three (3) months of the original workshop date and your place cannot be filled, your workshop fee may be forfeited in full. CapturEDU will attempt to rebook your spot, and if successful, any payments made will be transferred to the new workshop. Please note that CapturEDU reserves the right to cancel any workshop and will provide you with a full refund in such a scenario..

CANCELLATION BY THE PARTICIPANT

If the participant decides to cancel, please note that all payments made will be non-refundable (as previously stated). The cancellation must be communicated in writing to CapturEDU. Please be aware that any cancellation initiated by the participant will only take effect upon receipt of confirmation from CapturEDU. If you decide to leave the workshop for any reason after it has begun, CapturEDU is not obligated to provide any refunds for unused services.

In the event that you are unable to participate in the workshop after booking, join after its commencement, or depart before its conclusion, no refunds will be provided. Be aware that any third-party charges, such as those imposed by accommodation providers, travel agents, or tour and transport operators, are not included in the cancellation costs outlined in this agreement.

Consequently, the above-mentioned cancellation fees are in addition to any charges that may be levied by third-party service providers. By agreeing to these booking conditions, you acknowledge that any cancellation of your booking, however infrequent, may result in additional financial losses, and such losses will be solely your responsibility.

CANCELLATION BY CAPTUREDU

While cancellations by CapturEDU are infrequent, we reserve the right to cancel any workshop for any reason without prior notice. If, for some reason, CapturEDU needs to cancel your workshop, you will have the option to transfer amounts paid to an alternate departure date to another available CapturEDU workshop an available al or receive a full refund.

In instances where the cancellation is due to external events beyond CapturEDU's reasonable control (including but not limited to floods, fires, acts of God, natural disasters, disease outbreaks, wars or threats of war, physical unrest, political instability, riots and civil disturbances, terrorist activities (threatened or actual), strikes, port or airport closures, and technical issues with transport or services), then refunds or transferable amounts will be reduced by any unrecoverable costs. Please note that CapturEDU shall not be liable for reimbursement of any additional expenses incurred as a result of your booking, including but not limited to visa fees, vaccinations, and excess payments for travel insurance.

FEES

The workshop/tour cost includes tuition fees, single-occupancy accommodation, meals, transportation from the airport to the workshopd national park fees. However, the participants will shoulder all other expenses. This includes, but is not limited to, airfares, airport taxes, transportation costs incurred while traveling to the assembly point, and location(s), an any personal items.

We strongly recommend that participants secure insurance coverage or obtain suitable insurance policies for trip cancellation/interruption, travel accident, travel delay, baggage delay or theft coverage, as well as medical or hospitalization expenses, which are not included in the program's fee.

PRICES & SURCHARGES

CapturEDU reserves the right to impose surcharges up to 30 days prior to departure due to unfavorable changes in exchange rates, increases in airfares or other transportation costs, a rise in local operator costs, and taxes. If a surcharge results in an increase of more than 10% of the workshop price, participants may cancel their bookings within 14 days of notification and receive a full refund.

TIPS & GRATUITIES

During specific overseas workshops, it is customary and considerate (though not mandatory) to provide tips or gratuities to the local service providers that CapturEDU employs, such as guides or staff at specific lodges. Appropriate tipping amounts may vary, so participants should seek advice from their CapturEDU hosts to make sure everything is clear. Tips and gratuities are not included in the workshop price and should be considered an additional expense payable by the participant.

YOUR DETAILS

For CapturEDU to confirm your travel arrangements, you must provide all requested details upon booking. These necessary details include your full name as per your passport, date of birth, and any pre-existing medical conditions that might affect your ability to fulfill the travel arrangements. Failure to provide such information will result in our inability to confirm your booking.

AGE & FITNESS REQUIREMENTS

For the majority of CapturEDU's workshops, participants must be at least 18 years old at the time of travel. There is no maximum age limit. However, it's important for participants to note that some workshops may involve physical exertion. Participants should refer to the itinerary and specified "physical activity" level to determine their suitability for such a workshop.

Participants in CapturEDU's workshops must be in good physical condition, as they may encounter stairways, uneven terrain, and the need to carry equipment. Regular exercise is recommended prior to attending a workshop. If a participant must leave a trip due to the physical requirements being beyond their capabilities, no refunds will be issued for any unused portion of the trip.

CapturEDU reserves the right to decline bookings at its sole discretion if it feels participants are unsuitable or unprepared for the level of activity required. Participants must ensure that they have obtained proper medical advice and recommendations for their destination at least two months prior to travel; otherwise, CapturEDU shall not be held liable for any costs, losses, or damages suffered as a result of being unable to enter any country, nor shall refunds be granted for any unused portion of their travel arrangements.

MEDICAL

Participants in CapturEDU's workshops must generally be in good health, and any medical issues should be made known to us before the workshop begins. CapturEDU is not a medical facility and does not have the expertise or responsibility to advise on necessary medications or inoculations for safe participation, nor does it assume liability for the provision of medical care. We strongly urge trip members to ensure that their coverage is adequate.

ACCOMMODATION ARRANGEMENTS

CapturEDU aims to arrange shared accommodation whenever possible to facilitate discussions and learning among participants. We strive to make our workshops as comfortable as possible, and we encourage participants to make the most of the accommodations offered to optimize their enjoyment. Accommodations can vary depending on the location and nature of the workshop, but unless otherwise stated, all rooms are twin-share. For solo travelers, CapturEDU cannot guarantee accommodation with someone of the same sex. However, a single supplement for a private room may be available for an additional fee, subject to availability. Please note that most of our participants' waking hours are filled with activities and photography, and they rarely spend much time in their rooms. As such, those who opt for individual rooms may miss out on the amazing friendships that form between roommates.

INFORMATION AWARENESS

CapturEDU offers detailed itineraries and workshop descriptions on our website, www.captured.com, that outline the expected experiences for participants. All participants are required to read and understand this information comprehensively and conduct their own additional research to ensure they are adequately prepared for the workshop locations and experiences.

PASSPORT AND VISAS

For international CapturEDU workshops, all participants must possess a passport valid for at least six months beyond the duration of the workshop. It is the participant's responsibility to ensure they have the correct visas, permits, and certificates for any country they plan to visit during their workshop. CapturEDU accepts no liability if entry to a country is denied due to a participant's lack of appropriate travel documentation.

TRAVEL INSURANCE

Travel insurance is mandatory for all CapturEDU participants and must be obtained at the time of booking. The policy should provide a minimum coverage of US$200,000 for personal accident, death, medical expenses, and emergency repatriation. We also strongly recommend policies that cover cancellation, curtailment, personal liability, as well as loss of luggage and personal effects. All participants must provide proof of their travel insurance prior to the final workshop payment (90 days before departure); anyone failing to do so will not be permitted to join the trip.

CHANGE OF ITINERARY

While CapturEDU strives to operate all workshops according to the description provided, we reserve the right to alter the itinerary at any time without prior notice. Before departure: If CapturEDU makes a significant change affecting more than 20% of the workshop days, participants will be informed as soon as reasonably possible. If a significant change is made, participants may choose between accepting or cancelling their booking and obtaining a refund of all money paid to CapturEDU for that workshop. After departure: CapturEDU reserves the right to modify an itinerary after departure due to local circumstances or events beyond our control. Any additional costs associated with necessary changes will be covered by participants if required. No refunds will be offered due to changes forced upon us due to external factors, nor will CapturEDU be responsible for any incidental expenses incurred as a result.

YOUR LEADERS

We endeavour to secure the best photographic leaders available for our workshops. However, in some cases, a scheduled leader may need to be replaced. Should this occur, we will make every effort to bring in a suitable replacement. Guest leaders are only affordable if projected participant numbers are met.

AUTHORITY ON TOUR

Our workshops are led by a CapturEDU workshop leader, whose decision is final on all matters likely to affect the safety, well-being, or experience of any person participating in the trip. If you fail to comply with a decision made by a workshop leader or interfere with the well-being or mobility of the group, the workshop leader may direct you to leave the trip immediately without the right to a refund. CapturEDU may also choose not to include you in any future workshops booked. Participants must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited and must travel in accordance with CapturEDU's responsible travel guidelines.

PHOTOGRAPHIC & VIDEO CONSENT & RELEASE

By participating in a CapturEDU workshop, you hereby consent and agree that CapturEDU has the right to take or use photographs or video recordings of you (and/or your property) and to utilize these in any and all media, including online, now or hereafter known, and for any purpose whatsoever. You further consent that your name and identity may be revealed therein or by descriptive text or commentary. You grant CapturEDU a perpetual, royalty-free, worldwide, irrevocable license to publicly or privately use such photos and videos in print and electronic form and market and sell copies. Furthermore, you waive any rights, claims, or interest you may have to control the use of your identity or likeness in the photographs and videos, agreeing that any uses described herein may be made without compensation or additional consideration to you.

ACCEPTANCE OF RISK

By participating in a CapturEDU workshop, you acknowledge that these workshops often take participants to locations where the wildlife, political, cultural, and geographical attributes present dangers and physical challenges greater than those present in our daily lives. CapturEDU uses information from foreign government departments and reports from their contacts to assess whether an itinerary should operate. However, you are also responsible for familiarising yourself with all relevant travel information and the nature of your itinerary. Your decision to travel is made in light of this information, and you accept that you are aware of the personal risks associated with such travel.

LIMITATION OF LIABILITY OF CAPTUREDU

By making a reservation with CapturEDU, you understand and agree that your deposit payment signifies your acceptance of all terms and conditions outlined in this brochure, as well as the workshop application bearing your signature. CapturEDU shall not be held liable for any damages, losses, or expenses of any nature, including those resulting directly or indirectly from acts of God, detention, annoyance, weather, quarantines, strikes, civil disturbances, theft or criminal activity of any kind, government regulations, etc., over which it has no control.

Furthermore, CapturEDU is not responsible for additional expenses due to unforeseen delays caused by factors such as weather, theft or criminal activity of any kind, political disputes, acts of terrorism, strikes, sickness, failure of flights or other modes of transportation to arrive or depart on time, and other causes beyond its control. Nor can CapturEDU assume any responsibility for loss or damage to baggage or personal property. It also excludes liability for incidental or consequential damages, however, characterised.

CapturEDU reserves the right to substitute hotels and conference facilities, modify itineraries when necessary or advisable, and cancel any workshop prior to departure upon refunding all payments received, thereby releasing them from further liability. Additionally, they reserve the right to decline to accept or retain any person whose behavior could disrupt the trip itself - with no refunds given under such circumstances. Lastly, CapturEDU reserves the right to take photographic and film records of trips for promotional and/or commercial purposes.

By participating in a CapturEDU workshop, you acknowledge and agree that the workshops are conducted at third-party venues over which CapturEDU has no control in terms of safety, security, and layout. You also acknowledge that CapturEDU employs third-party organisations, agencies, and individuals to assist in conducting the workshops and that CapturEDU is not liable for any acts or omissions of such parties. By participating in this photography workshop, you acknowledge and assume all risks, liabilities, and hazards, including physical injury, sickness, or death, that may arise from such participation. You also acknowledge that participating in activities such as boat trips, plane rides, helicopter travels, car rides, or any other form of transportation during the workshop involves inherent risks, and as such, you participate in such activities at your own risk and are solely responsible for any loss or damage to yourself or your property.

If you borrow any equipment belonging to CapturEDU during the workshop, you assume all risks associated with its use, whether or not you have CapturEDU's consent, and you acknowledge CapturEDU's refusal to warrant the suitability and the purpose of the borrowed equipment.

To the fullest extent permitted by law:

• All liability for any loss, death, injury, or damage you may experience directly or indirectly related to your participation in a photography workshop or any violation of the booking terms is excluded.

• You waive any claims against CapturEDU, its officers, employees, agents, and representatives and release them from any liability arising out of or connected with your participation in a photography workshop.

• Any condition or warranty that would otherwise be implied in the Booking Conditions by law (such as an Implied Warranty) is excluded.

To the extent that it is legally permissible to exclude an Implied Warranty, CapturEDU's liability for the Implied Warranty is limited to (at CapturEDU's absolute discretion) (i) providing a workshop of similar value to the one you missed or (ii) refunding the total amount received by CapturEDU related to your booking. Any claim by you is excluded if it is for indirect or consequential loss, loss of profits, economic loss, or any form of indirect, special, punitive, or exemplary damages, regardless of the cause.

CONSUMPTION OF ALCOHOL

At some CapturEDU workshops, alcohol may be made available. By participating in workshops where alcohol is present, you assume full responsibility for your actions while under the influence, and CapturEDU shall not be held responsible for any consequences arising from your consumption of alcohol.

OPTIONAL ACTIVITIES

Any optional activities that are not included in the workshop price do not form part of the workshop or this agreement. You acknowledge that any assistance provided by the workshop leader or local representative in arranging such optional activities does not make CapturEDU liable in any way. The contract for any optional activity will exist exclusively between you and the activity provider, with CapturEDU not being a party to such a contract.

CLAIMS & COMPLAINTS

If you have any complaints about your workshop, please inform your workshop leader as soon as possible so they can attempt to resolve the matter. If your complaint remains unresolved despite the workshop leader's efforts, you must submit a written complaint to CapturEDU within 30 days of the workshop's conclusion.

SEVERABILITY

In the event that any term or condition in these Booking Conditions becomes unenforceable or void due to the operation of law or is viewed as against public policy for any other reason, such a term or condition will be deemed severed from this agreement or revised accordingly. This adjustment will ensure the continuation of all remaining terms and conditions as binding.

PRIVACY POLICY

CapturEDU may collect personal information from you to facilitate a workshop. Your information will be handled according to CapturEDU's privacy policy, which can be found at www.capturedu.com.au.

COMMUNICATION CONSENT

By attending our workshops, you are giving consent to CapturEDU to communicate with you post-workshop to provide information and promotional materials, strictly in compliance with CapturEDU's privacy policy, accessible at www.capturedu.com.au.

APPLICABLE LAW

These Booking Conditions are governed by and construed in accordance with the laws of Victoria, Australia, to the extent permitted by law. Any disputes that arise in connection with a workshop or these Booking Conditions must be formally lodged in the courts of New South Wales, Australia.

UPDATING OF TERMS & CONDITIONS

CapturEDU reserves the right to modify and/or amend these terms and conditions as required. It is your responsibility to review and understand them. The most recent version can always be found on the CapturEDU website, www.capturedu.com.au, and will replace any prior versions.
